Social Security, along with the Office of the Inspector General, identifies and aggressively prosecutes those who commit fraud. Our zero tolerance approach has resulted in a fraud incidence rate that is a fraction of one percent.

In fiscal year 2018, with the help of state and local law enforcement, the program reported nearly $188.5 million in projected savings to the disability programs. This resulted in a return on investment of $17 for each $1 spent.

Extended Period Of Eligibility

Following your trial work period, you will enter a 36-month extended period of eligibility. It is in this period that you can work and still receive benefits only as long as your earnings are less than what Social Security considers substantial. Social Security deducts what they consider work expenses that are a direct result of your disability from your total monthly earnings. These work expenses can range from prescription drug copays, transportation to and from work, and specialized work equipment.

Which States Offer Supplementary Disability Payment Programs

The majority of all disability payment programs are administered on the federal level, but there are five states that offer state-funded disability programs in addition to SSDI and SSI. Currently, those five states are California, Hawaii, New Jersey, New York and Rhode Island. They are intended to supplement, but not replace, federal disability payment programs.

Special Rules For People Who Are Blind Or Have Low Vision

We consider you to be legally blind under Social Security rules if your vision cannot be corrected to better than 20/200 in your better eye. We will also consider you legally blind if your visual field is 20 degrees or less, even with a corrective lens. Many people who meet the legal definition of blindness still have some sight and may be able to read large print and get around without a cane or a guide dog.

If you do not meet the legal definition of blindness, you may still qualify for disability benefits. This may be the case if your vision problems alone or combined with other health problems prevent you from working.

There are several special rules for people who are blind that recognize the severe impact of blindness on a person’s ability to work. For example, the monthly earnings limit for people who are blind is generally higher than the limit that applies to non-blind workers with disabilities.

Many injuries and illnesses are obviously disabling, such as late stage kidney disease, congestive heart failure, and advanced cancers. There are others, however, such as chronic illnesses that become acute with age, or residual conditions that deteriorate over time, that eventually become disabling even though they were not initially too severe. For example, a worker may have had a previous back injury that is aggravated through the years to the point where work is extremely difficult or impossible. That person may become eligible for disability benefits even though the original illness or injury was not disabling.

Because Social Security disability is a government program, its features include a good number of qualifying rules and regulations. To receive Social Security disability benefits, all three of the following must be true:

  • You must have a physical or mental impairment.

  • The disability must be expected to last, or have lasted, at least 12 months, or it must be expected to result in death.

Your Impairment Does Not Have To Be On The Ssas List

If you want to apply for Social Security Disability benefits, it is important to note that your impairment does not have to appear on the SSAs list. Examples of such conditions include carpal tunnel syndrome and celiac disease, among others.

However, you must present a formal diagnosis of your condition to the SSA that shows it is a medically determinable impairment that prevents you from functioning in full capacity. This means your condition must be severe enough to prevent you from working or performing your daily activities. This reduction in capacity is known as the residual functional capacity.

If your disability meets the SSAs requirements, it might consider it to be equivalent to a listed condition. You must obtain this diagnosis from your doctor to prove your condition, but it is only the start of the process. It does not mean you will automatically receive approval for benefits.

Back Payments For Disability Benefits

After the SSA approves you for SSDI or SSI, you might receive back payments. You might be eligible for back pay if your disability started well before you start receiving benefits.

    What Makes Someone Eligible For Disability

    The criteria for being eligible for disability is strict. At a base level, there are three qualifications you must meet:

    • You must first have worked in jobs where you paid Social Security payroll taxes.
    • You have a long-lasting medical condition that meets the SSAs definition of disability.
    • Your condition renders you incapable of working for a year or more.

    How Much Work Do You Need To Qualify

    To be eligible for disability benefits, you must meet a duration work test, and a recent work test.

    Most people who qualify for SSDI have extensive work histories. In fact, federal law requires that SSDI recipients must have worked at least one-fourth of their adult lives and at least five of the last 10 years . However, for claimants aged 21-31, the SSA adjusts these numbers down slightly.

    Research by the SSA shows that most successful SSDI applicants have worked every year since turning 21. And three-quarters of them have worked 80% of those years.

    How does the SSA keep track of qualified work? The answer is that they record work credits. SSA work credits are based on your total yearly wages or self-employment income, though the amount needed for one credit changes annually. In 2021, for every $1,470 in taxable earnings you made, you earned one Social Security credit. You had to earn $5,880 to get the maximum four credits for the year.

    Though you may earn more credits than the max, extra credits wont enhance your eligibility for SSDI. However, the higher your working year earnings, the greater your chances for a larger monthly payment if you do qualify.

    Finally, if you earn more than $1,350/month when you apply for SSDI in 2022, the SSA will reject your claim. It will also be harder to prove disability if youre working in any capacity.

    Some 455,000 workers received Social Security disability in 19601 by 2011 over 18 million people were receiving some form of benefits from Social Security disability.     What Is The Standard For Disability

    Who is considered “disabled” for SSI or SSDI benefits?

    To receive benefits under either program, you must meet the SSA’s definition of disability. The term disability means that you are unable to engage in substantial gainful activity because of:

    • A medically determinable physical or a mental impairment
    • Which has lasted or is expected to last for at least 12 months or is expected to result in death.

    This standard for disability is described in the below paragraphs.

    Disability for adults

    In deciding whether you meet the disability requirement, SSA uses a five-step analysis:

    Step one: are you working?

    If you are working and performing a substantial gainful activity, then you are considered able to work. You are therefore not disabled. The SGA limit is $1,310 per month. If you earn more than $1,310 per month, you are probably not eligible, unless there are special cases. For example, you have intensive job coaching to help you work or you work at a sheltered workshop. If you are not earning significant income, proceed to step two.

    Step two: do you have a severe impairment?
