Social Security erroneously releases private information

This course explains the process of using the Freedom of Information Act to request information from SSA. It also identifies circumstances when it is unnecessary to make requests through FOIA, and, instead, use online resources or personal contacts as sources of obtaining information.

    1. The Freedom of Information Act

    Enacted in 1966, and taking effect on July 5, 1967, the FOIA provides any person the right to obtain access to federal agency records, except to the extent that such records are protected from public disclosure. A FOIA request can be made for any agency record. Before sending a request to a federal agency, you should determine which agency is likely to have the records you are seeking. Each agencys website will contain information about the type of records that agency maintains.

    Gather 2022 Tax Documents

    Taxpayers should develop a recordkeeping system electronic or paper that keeps important information in one place. This includes year-end income documents like Forms W-2 from employers, Forms 1099 from banks or other payers, Form 1099-K from third party payment networks, Form 1099-NEC for nonemployee compensation, Form 1099-MISC for miscellaneous income, or Form 1099-INT if you were paid interest, as well as records documenting all digital asset transactions.

    Whelan received a “bad conduct discharge” from the Marines in 2008. In terms of severity of punishment, this form of discharge is second to and distinct from a dishonorable discharge.

    On Dec. 8 2022, WNBA star Brittney Griner was released to American custody after spending nearly 10 months as a prisoner in the Russian penal system on marijuana-related charges. Her release was secured via a prisoner exchange in which U.S. authorities released convicted Russian arms dealer Viktor Bout.

    Griner’s release renewed attention on another American citizen detained in Russia: Paul Whelan. Since late 2018, he has been held on espionage charges, which he denies. Though U.S. President Joe Biden had been attempting to secure the release of both Griner and Whelan in one move, Russian authorities refused to include Whelan in any trade.

    Some critics of Biden have faulted him for not bringing Whelan back, often citing Whelan’s service in the Marines as part of that argument. Whelan’s family, for their part, have been supportive of Griner’s release.

    Such a punishment generally disqualifies a former Marine from receiving Veterans Affairs benefits. As described in a military justice fact sheet, this is “one of two types of punitive discharges that may be imposed on an enlisted person” and is “less severe than a Dishonorable Discharge.”

    It shall be unlawful for any Federal, State or local government agency to deny to any individual any right, benefit, or privilege provided by law because of such individuals refusal to disclose his social security account number.

    theprovisions of paragraph of this subsection shall not apply with respect to

    any disclosure which is required by Federal statute, or

    the disclosure of a social security number to any Federal, State, or local agency maintaining a system of records in existence and operating before January 1, 1975, if such disclosure was required under statute or regulation adopted prior to such date to verify the identity of an individual.

    Any Federal, State, or local government agency which requests an individual to disclose his social security account number shall inform that individual whether that disclosure is mandatory or voluntary, by what statutory or other authority such number is solicited, and what uses will be made of it. Section 7 of the Privacy Act of 1974, as amended, 5 U.S.C. § 552a note ).

    Although this provision applies beyond federal agencies, it does not apply to: any disclosure which is required by federal statute or any disclosure of a social security number to any federal, state, or local agency maintaining a system of records in existence and operating before January 1, 1975, if such disclosure was required under statute or regulation adopted prior to such date to verify the identity of an individual.     Federal, state, and local agencies may deny an individual a right, benefit, or privilege provided by law because of such individuals refusal to disclose the individuals social security number if required under statute or regulation adopted prior to January 1, 1975, and used to verify the identity of an individual.

    A second exception to the general provisions of section 7 is set out in subsection 7, which grandfathers statutes or regulations in effect before January 1, 1975, and provides that the prohibition on denying a benefit because of an individuals failure to provide a social security number does not apply to those statutes and regulations.     A Exception For Disclosures Required By Federal Statute

    Federal, state, and local agencies may deny an individual a right, benefit, or privilege provided by law because of such individuals refusal to disclose the individuals social security number if the disclosure is required by federal statute.

    A key statute that requires the disclosure of social security numbers is the Social Security Act , which expressly permits a state agency to use social security numbers for the purpose of identifying individuals in the administration of any tax, general public assistance, drivers license, or motor vehicle registration law within its jurisdiction, see 42 U.S.C. § 405 . The SSA also permits a state agency to use social security numbers to issue birth certificates and to enforce child support orders, the Secretary of Agriculture to use social security numbers in administering the Food and Nutrition Act of 2008, and the Federal Crop Insurance Corporation to use them in administering the Federal Crop Insurance Act.     Step 1 Download the entire document
