File and suspend was a Social Security claiming strategy that allowed married couples of full retirement age to receive spousal benefits and delay retirement credits at the same time. It was ended as of May 1, 2016, by the Bipartisan Budget Act of 2015, signed on Nov. 2, 2015, by President Obama, and so is no longer a viable strategy.

Here are a few things to consider before punching that timecard.

If You’re Not Sure Why You Received A Payment

If you receive a check or direct deposit payment from the Treasury Department and do not know what its for, contact the regional financial center that issued it. Only the agency that authorized the payment can explain why you received it.

If you received a check, look for the RFCs city and state at the top center. Then contact that RFC to find out which federal agency authorized the payment. It will be one of these:

If you received payment byelectronic funds transfer , or direct deposit, follow the directions under Find Information About a Payment.

Use the Treasury Check Verification System to verify that the check is legitimate and issued by the government.

Filing An Initial Claim

What information do I need to file a new application?

When filing a new application, you will need the following information:

  • Your Social Security number
  • Full mailing address, including apartment or lot number, Zip Code and PO Box if you use one
  • A phone number where you can be reached during the day
  • The name and mailing address of your last employer, no matter how long you worked there
  • Note: Your paycheck stub or W-2 form usually contains this information
  • The date you began and stopped working for each employer and the reason you left each job for the last 18 months
  • The county in which you live
  • Your driver’s license number
  • If you are not a citizen or national of the United States, your employment authorization number and expiration date
  • If you were active duty military within the past 18 months, your DD-214, Member #4 form
  • If you were a federal employee, your Standard Form SF-50 or pay stub
  • Any separation, vacation, or holiday pay you have received or will receive in the future.

A record of your application will not be established unless you are told your claim has been accepted. If you are unable to complete your application, the information you have entered will be saved for 7 days from the date you began filing the claim so that you can complete it later and within 7 days.

The File And Suspend Strategy

The file and suspend strategy allowed your spouse to collect a spousal benefit based on your earnings record while you delayed the start of your own benefits, thus maximizing your own benefit by accumulating delayed retirement credits. This strategy worked if you attained your full retirement age and suspended benefits prior to April 30, 2016.

Hi Jim, I cant tell you for sure because it depends on how your application was worded and whether or not you want your benefits to resume as soon as your earnings permit payment. If you chose a specific month of election to start your benefits when you completed your original application, then Social Security couldnt adjust your benefit rate to compensate you for the months of non-payment until you reach full retirement age .

That means youd then be stuck with your age 62 rate at least until you reach FRA. However, if you filed your application with a Social Security representative and you chose a conditional month of election to start your benefits, then Social Security may be able to adjust your benefit rate to your January 2021 rate without you withdrawing and refiling.

I would suggest that you check with Social Security to see if theyll be able to adjust your rate prior to FRA or not. If not, then you would probably better off to withdraw your previous claim and reapply effective with whatever month you wish to begin receiving benefits. Youre limited to one application withdrawal in a lifetime, though, so make sure that you end up choosing the right month to start your benefits when you reapply.

Current retirees probably have the least to worry about when it comes to receiving Social Security. Older adults are also due to receive a pay bump in January, thanks to a cost-of-living adjustment, making payments higher by 8.7%. For the average beneficiary, thats an extra $146 for a total of $1,827 per monthly check. This hopefully means that your Social Security dollars can retain their purchasing power against inflated prices on everything from food to gas and travel.     Suspending All Benefits Under File And Suspend

    To further limit some of the perceived loophole abuses under voluntary suspension claiming strategies, the Bipartisan Budget Act also includes a new Social Security Act subsection 202, which stipulates that if an individual chooses to suspend benefits, then:

    1) All benefits payable to that individual will be suspended, based on both his/her own earnings record and also based on any other persons earnings record .

    2) No other individual will be eligible for benefits based on the earnings record of the person who voluntarily suspends benefits.

    The first prong of these new rules puts yet another nail in the coffin for any type of restricted application strategy, as not only will the deemed application rules require that if an individual is eligible for one benefit then both must be claimed, but for those who suspend a benefit, both must be suspended.

    The second provision, however, effectively kills all of the File-and-Suspend strategies as well. After all, the whole point of the file and suspend strategy was that if one person files and suspends benefits at full retirement age, he can earn delayed retirement credits while making his wife eligible for spousal benefits. Yet under these new rules, when the husband suspends, it suspends not only his benefits, but all benefits payable based on his earnings record, which means he would no longer be able to trigger spousal benefits either .

    File And Suspend And Restricted Application Under The Senior Citizens Freedom To Work Act

    In 2000, President Clinton signed into law the Senior Citizens Freedom to Work Act, which was intended to increase the flexibility for seniors to continue working even while receiving Social Security benefits. Accordingly, the new rules eliminated the Earnings Test for those who had reached full retirement age , and gave those who were already receiving benefits at full retirement age the opportunity to suspend their benefits to earn delayed retirement credits.

    While the original purpose of these voluntary suspension rules were simply to allow those who had already claimed Social Security benefits to cease receiving benefits and earn delayed retirement credits, a secondary strategy emerged soon thereafter retired couples could choose to file for benefits at full retirement and then immediately suspend. The reason: by filling for benefits, a spouse or even dependent children could become eligible for their benefits, and by suspending the primary worker could still not receive benefits and earn delayed retirement credits. This was far more appealing than the prior alternative, where if the primary worker wanted to earn delayed retirement credits by waiting until age 70, all related benefits were held hostage until that time as well.
