Please note that F-1 students who have been offered on-campus employment must wait at least 15 days after entering the U.S. to submit a social security card application. The SSA office may take between 2 to 4 weeks to process the social security application and to send an official social security card to students.

New York Appeals Process

Rochester Social Security Office and long wait times

There are four steps to the appeals process in New York.

  • Step 1: Reconsideration. A different claims examiner at New York’s Division of Disability Determinations review the case and decides whether you are disabled.
  • Step 2: Administrative Law Judge Hearing. At this hearing, the ALJ will consider any new evidence and will review the decision that was made.
  • Step 3: Appeals Council. The Appeals Council will only hear cases that it finds were decided based on incorrect procedures. If the AC rules a case was decided incorrectly, the AC can hear the case itself or send it back to the ALJ to be retried.
  • Step 4: Federal Court Case. If the appeals through SSA are unsuccessful, you can bring your case to federal court in New York. There are four federal district courts in New York.

New York Social Security Disability

Each and every year, millions of disabled American citizens apply for Social Security Disability benefits. In New York, approximately 57 percent of the disability claims received are denied by the Social Security Administration . When a Social Security Disability applicant is denied Social Security Disability benefits, they are able to go directly to the hearing stage of the disability appeal process. This is actually good news because previously, when New York Social Security Disability applicants had to pursue a Request for Reconsideration before obtaining a hearing before an administrative law judge, more than 80 percent of disability appeals were denied at the initial stage of the appeal process. New York Social Security Disability applicants can bypass the Reconsideration Request and request a hearing as soon as their initial disability application is denied. Unfortunately, it can take New York Social Security Disability applicants anywhere from 274 to 612 days to obtain their disability hearing.

The SSA’s Office of Disability Adjudication and Review is the agency responsible for managing Social Security Disability hearings. The area in which you live will determine which New York ODAR office handles your New York Social Security Disability case.
